Views:
 The Freedom of Information Act (FOIA) allows a component to extend the response time by 10 business days if:
  • The component needs to collect records from field offices
  • The request involves a large amount of records
  • The request involves unusual circumstances

 

Unusual circumstances include:

 

  • The need to search and collect documents from offices separate from the office processing the request
  • The need to search and collect a large volume of records
  • The need to consult with another agency 
The FOIA Act gives the OMB a minimum of 20 working days to respond to a request. The OMB can also extend that time period an additional 10 working days. 
Agencies must now give requesters a minimum of ninety days to file an administrative appeal.
